Unsere Produkte und Plattformen bieten wir auf eigenen Websites an. Für deren Nutzung gelten ausschließlich die dort veröffentlichten Vertragsbedingungen und Datenschutzhinweise. Diese AGB gelten dafür nicht.
§ 2 Kein Vertragsschluss über diese Website
Die Inhalte dieser Website informieren über NUICORN, unsere Produkte, Plattformen und Themen. Sie sind kein verbindliches Angebot.
Über diese Website schließen wir keine kostenpflichtigen Verträge. Anfragen über das Kontaktformular oder per E-Mail sind unverbindlich. Entsteht daraus eine Zusammenarbeit, vereinbaren wir sie in einem gesonderten Vertrag.
§ 3 Newsletter
Der Newsletter ist kostenlos. Du meldest dich im Double-Opt-in-Verfahren an: Erst wenn du deine Anmeldung über den Link in unserer Bestätigungs-E-Mail bestätigst, erhältst du den Newsletter.
Du kannst den Newsletter jederzeit ohne Angabe von Gründen abbestellen, über den Abmeldelink in jeder Ausgabe oder per E-Mail an .
Inhalt, Umfang und Häufigkeit des Newsletters können wir jederzeit ändern und den Versand auch einstellen. Ein Anspruch auf Zusendung besteht nicht. Wie wir dabei mit deinen Daten umgehen, erklären unsere Datenschutzbestimmungen (öffnet in neuem Tab).
§ 4 Haftung
Wir haften unbeschränkt bei Vorsatz und grober Fahrlässigkeit, für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit sowie nach dem Produkthaftungsgesetz.
Verletzen wir leicht fahrlässig eine wesentliche Pflicht, deren Erfüllung die ordnungsgemäße Nutzung erst ermöglicht und auf deren Einhaltung du regelmäßig vertrauen darfst, ist unsere Haftung auf den vorhersehbaren, typischerweise eintretenden Schaden begrenzt. Im Übrigen ist unsere Haftung für leichte Fahrlässigkeit ausgeschlossen.

Wir können diese AGB mit Wirkung für die Zukunft ändern, etwa wenn sich die Rechtslage ändert oder wir Funktionen der Website anpassen. Es gilt die Fassung, die zum Zeitpunkt deiner Nutzung auf dieser Seite veröffentlicht ist.
§ 7 Anwendbares Recht
Es gilt das Recht der Bundesrepublik Deutschland. Bist du Verbraucherin oder Verbraucher, gilt diese Rechtswahl nur, soweit dir dadurch nicht der Schutz zwingender Vorschriften des Staates entzogen wird, in dem du deinen gewöhnlichen Aufenthalt hast.

§ 4 Liability
We are liable without limitation in cases of intent and gross negligence, for damage resulting from injury to life, body, or health, and under the German Product Liability Act (Produkthaftungsgesetz).
If we breach, through slight negligence, an essential obligation whose fulfilment makes proper use possible in the first place and on whose observance you may regularly rely, our liability is limited to the foreseeable damage that typically occurs. In all other respects, our liability for slight negligence is excluded.
These liability rules also apply to our employees and vicarious agents.

We are neither willing nor obligated to participate in dispute resolution proceedings before a consumer arbitration board.

The law of the Federal Republic of Germany applies. If you are a consumer, this choice of law applies only insofar as it does not deprive you of the protection of the mandatory provisions of the country in which you have your habitual residence.

If individual provisions of these GTC are or become invalid, the remaining provisions remain valid. The statutory provisions take the place of the invalid provision.

3. Hosting und Bereitstellung der Website
Unsere Website wird bei Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA („Cloudflare“) betrieben. Cloudflare stellt die Server, ein weltweites Netz zur Auslieferung der Inhalte (Content Delivery Network), die Namensauflösung unserer Domain und den Schutz vor Angriffen bereit.
Bei jedem Aufruf der Website verarbeitet Cloudflare die Daten, die dein Browser technisch bedingt übermittelt:
- IP-Adresse,
- Datum und Uhrzeit des Zugriffs,
- aufgerufene Seite oder Datei und übertragene Datenmenge,
- die Website, von der du zu uns gekommen bist (Referrer),
- Browser, Betriebssystem und Spracheinstellung.
Diese Daten sind nötig, um dir die Website anzuzeigen und ihren stabilen und sicheren Betrieb zu gewährleisten, insbesondere um Angriffe und Missbrauch zu erkennen und abzuwehren. Rechtsgrundlage ist unser berechtigtes Interesse an einer sicheren und zuverlässigen Bereitstellung der Website (Art. 6 Abs. 1 lit. f DSGVO).
Zum Schutz unserer Formulare vor Missbrauch begrenzen wir die Zahl der Anfragen, die innerhalb einer Minute von einer IP-Adresse gesendet werden können. Die IP-Adresse wird dafür nur kurzzeitig verarbeitet und nicht dauerhaft gespeichert. Fehler- und Ablaufprotokolle unserer Anwendung, die bei Cloudflare anfallen, werden nach spätestens sieben Tagen automatisch gelöscht.
Außerdem schützen wir unsere Formulare (Kontakt, Newsletter, Benachrichtigungen über Änderungen und Löschanträge) mit Cloudflare Turnstile vor automatisierten Einsendungen. Kommt ein Formular in den sichtbaren Bereich oder wählst du eines seiner Felder aus, lädt dein Browser dafür ein Skript von Cloudflare (challenges.cloudflare.com). Es prüft im Hintergrund, ob ein Mensch die Seite nutzt, und verarbeitet dafür deine IP-Adresse, technische Merkmale deines Browsers und deiner Verbindung, etwa die Browserkennung (User-Agent) und den TLS-Fingerabdruck, sowie die Website, auf der das Formular steht. Deine Eingaben im Formular erhält Cloudflare dabei nicht. Meist bemerkst du von der Prüfung nichts; nur in Zweifelsfällen bittet dich Turnstile, ein Kästchen anzuklicken. Cookies setzt Turnstile nicht, es legt aber im lokalen Speicher deines Browsers einen Eintrag für challenges.cloudflare.com an („cf.turnstile.u“), den Cloudflare für die Prüfung nutzt und der dort bleibt, bis du ihn löschst. Das Ergebnis der Prüfung ist ein Prüfcode, der fünf Minuten gültig ist und mit deiner Einsendung an unseren Server geht. Der Server lässt ihn mit deiner IP-Adresse einmal von Cloudflare bestätigen und speichert ihn nicht.
Rechtsgrundlage ist unser berechtigtes Interesse, unsere Formulare und Postfächer vor Spam und Missbrauch zu schützen (Art. 6 Abs. 1 lit. f DSGVO). Soweit Turnstile dafür Informationen in deinem Browser speichert oder ausliest, ist das unbedingt erforderlich, damit wir die Formulare, die du nutzen möchtest, sicher bereitstellen können (§ 25 Abs. 2 Nr. 2 TDDDG). Für die Prüfung verarbeitet Cloudflare die Daten in unserem Auftrag. Um die Bot-Erkennung von Turnstile zu verbessern, nutzt Cloudflare sie außerdem als eigener Verantwortlicher, gestützt auf sein berechtigtes Interesse. Mit Cloudflare haben wir einen Vertrag über die Auftragsverarbeitung geschlossen (Art. 28 DSGVO). Cloudflare kann Daten auch in den USA verarbeiten. Cloudflare ist nach dem EU-US Data Privacy Framework zertifiziert, für das ein Angemessenheitsbeschluss der EU-Kommission besteht (Art. 45 DSGVO); zusätzlich sind Standardvertragsklauseln vereinbart (Art. 46 Abs. 2 lit. c DSGVO). 4. Hintergrundvideos
Alle Hintergrundvideos dieser Website liefern wir über Cloudflare Stream aus, einen Videodienst von Cloudflare. Dein Browser lädt diese Videos von Servern von Cloudflare und übermittelt dabei deine IP-Adresse und die technischen Angaben aus Abschnitt 3. Cookies werden dabei nicht gesetzt.
Rechtsgrundlage ist unser berechtigtes Interesse an einer schnellen und zuverlässigen Auslieferung von Videoinhalten (Art. 6 Abs. 1 lit. f DSGVO). Es gelten der Vertrag über die Auftragsverarbeitung und die Garantien für Übermittlungen in die USA aus Abschnitt 3.
5. Schriftarten und weitere Inhalte
Schriftarten, Icons und Bilder liefern wir zusammen mit der Website selbst aus (Abschnitt 3). Verbindungen zu externen Schriftanbietern wie Google Fonts finden nicht statt.
6. Kontaktformular und Kontakt per E-Mail
Wenn du uns über das Kontaktformular schreibst, verarbeiten wir deinen Namen, deine E-Mail-Adresse und deine Nachricht, dein Unternehmen und deine Website, wenn du sie angibst, sowie die Seite, von der aus du die Anfrage gesendet hast, und den Zeitpunkt der Anfrage. Ein unsichtbares Prüffeld hilft uns, automatisierte Spam-Einsendungen zu erkennen; dafür erheben wir keine weiteren Daten.
Die Website speichert deine Angaben nicht. Sie werden über den E-Mail-Dienst von Cloudflare direkt als E-Mail an uns übermittelt. Unser E-Mail-Postfach betreibt Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, D18 P521, Irland („Microsoft“), im Rahmen von Microsoft 365. Dort liegen auch E-Mails, die du uns direkt schreibst.
Wir verarbeiten deine Angaben, um deine Anfrage zu beantworten. Rechtsgrundlage ist Art. 6 Abs. 1 lit. b DSGVO, wenn deine Anfrage auf einen Vertrag oder eine Zusammenarbeit abzielt, und im Übrigen unser berechtigtes Interesse an der Beantwortung von Anfragen (Art. 6 Abs. 1 lit. f DSGVO).
Wir löschen deine Anfrage, sobald sie abschließend bearbeitet ist, es sei denn, gesetzliche Aufbewahrungspflichten, etwa nach Handels- oder Steuerrecht, verlangen eine längere Speicherung.
Mit Microsoft haben wir einen Vertrag über die Auftragsverarbeitung geschlossen. Microsoft kann Daten auch in den USA verarbeiten. Die Microsoft Corporation ist nach dem EU-US Data Privacy Framework zertifiziert; zusätzlich sind Standardvertragsklauseln vereinbart. Mehr dazu in der Datenschutzerklärung von Microsoft.
7. Newsletter
Mit unserem Newsletter informieren wir über NUICORN, unsere Produkte und Plattformen sowie über Beiträge und Entwicklungen rund um künstliche Intelligenz. Für die Anmeldung brauchen wir nur deine E-Mail-Adresse.
Wir nutzen das Double-Opt-in-Verfahren: Nach deiner Anmeldung erhältst du eine E-Mail mit einem Bestätigungslink. Erst wenn du ihn anklickst, nehmen wir dich in den Verteiler auf. Um deine Einwilligung nachweisen zu können, speichern wir den Zeitpunkt der Anmeldung und der Bestätigung sowie die dabei verwendete IP-Adresse.
Für Versand und Verwaltung des Newsletters nutzen wir Mailchimp, einen Dienst der The Rocket Science Group LLC, 405 N Angier Ave. NE, Atlanta, GA 30308, USA („Mailchimp“). Deine E-Mail-Adresse und die Anmeldedaten werden auf Servern von Mailchimp in den USA gespeichert. Mit Mailchimp haben wir einen Vertrag über die Auftragsverarbeitung geschlossen. Mailchimp ist als Teil der Intuit-Gruppe nach dem EU-US Data Privacy Framework zertifiziert (Art. 45 DSGVO); zusätzlich sind Standardvertragsklauseln vereinbart. Unsere Newsletter enthalten ein unsichtbares Zählpixel und personalisierte Links. Damit erkennen wir, ob und wann ein Newsletter geöffnet wurde und welche Links angeklickt wurden. Wir nutzen diese Auswertung, um unsere Inhalte zu verbessern, und erstellen daraus keine Werbeprofile.
Rechtsgrundlage für den Newsletter und seine Auswertung ist deine Einwilligung (Art. 6 Abs. 1 lit. a DSGVO, § 25 Abs. 1 TDDDG). Du kannst sie jederzeit mit Wirkung für die Zukunft widerrufen, über den Abmeldelink in jedem Newsletter oder per E-Mail an . Die Auswertung lässt sich nicht getrennt abbestellen; wenn du sie nicht möchtest, bestelle bitte den Newsletter ab.
Nach deiner Abmeldung speichern wir deine E-Mail-Adresse in einer Sperrliste, damit du keine weiteren Newsletter erhältst, und bewahren den Nachweis deiner Einwilligung auf, solange daraus Ansprüche geltend gemacht werden können, in der Regel drei Jahre. Rechtsgrundlage ist unser berechtigtes Interesse an einem rechtssicheren Newsletterversand (Art. 6 Abs. 1 lit. f DSGVO).
8. Benachrichtigungen über Änderungen der rechtlichen Dokumente
Auf dieser Seite kannst du dich dafür anmelden, dass wir dir eine E-Mail schicken, wenn wir eines unserer rechtlichen Dokumente ändern. Dafür brauchen wir nur deine E-Mail-Adresse. Die Anmeldung läuft wie beim Newsletter im Double-Opt-in-Verfahren über Mailchimp; was dort mit deinen Daten geschieht, wo sie gespeichert werden und welche Garantien gelten, steht in Abschnitt 7. In Mailchimp kennzeichnen wir deine Adresse als Empfänger dieser Benachrichtigungen. Die Benachrichtigungen kommen von . Wir werten bei ihnen nicht aus, ob du sie öffnest oder Links anklickst.
Rechtsgrundlage ist deine Einwilligung (Art. 6 Abs. 1 lit. a DSGVO). Du kannst sie jederzeit mit Wirkung für die Zukunft widerrufen, über den Abmeldelink in jeder Benachrichtigung oder per E-Mail an . Newsletter und Benachrichtigungen teilen sich in Mailchimp eine Empfängerliste: Hast du beides abonniert, beendet der Abmeldelink beides. Möchtest du nur eines davon abbestellen, schreib uns an die jeweilige Adresse. Nach der Abmeldung gilt für deine Daten dasselbe wie beim Newsletter (Abschnitt 7).
9. Links zu sozialen Netzwerken und anderen Websites
Wir verlinken unsere Profile bei LinkedIn, X und GitHub sowie Quellen und andere Websites. Unter unseren Beiträgen kannst du Artikel über Links bei Facebook, X und LinkedIn teilen. Das sind einfache Links, keine eingebundenen Plugins: Solange du sie nicht anklickst, werden keine Daten an diese Anbieter übertragen. Nach dem Klick gelten die Datenschutzbestimmungen des jeweiligen Anbieters. 10. Cookies, Einwilligung und Google Analytics
Beim ersten Besuch fragen wir dich in einem Cookie-Banner, welche Arten von Cookies du zulässt. Notwendige Speicherungen sind immer aktiv, Statistik und Marketing bleiben ausgeschaltet, bis du sie erlaubst. Deine Auswahl speichern wir nur im lokalen Speicher deines Browsers (Local Storage), nicht auf unseren Servern. Diese Speicherung ist für die Verwaltung deiner Einwilligung unbedingt erforderlich und daher ohne Einwilligung zulässig (§ 25 Abs. 2 Nr. 2 TDDDG). Das Banner (Silktide Consent Manager) liefern wir selbst aus; dabei werden keine Daten an Dritte übertragen.
Sendet dein Browser das Signal „Global Privacy Control“ (GPC), behandeln wir das wie die Auswahl „Nur notwendige“: Das Banner öffnet sich nicht von selbst, Statistik und Marketing bleiben aus, und eine frühere Einwilligung gilt als widerrufen, sobald dein Browser das Signal sendet. Über das Cookie-Symbol unten links kannst du beides trotzdem bewusst einschalten.
Wenn du Statistik zulässt, nutzen wir Google Analytics 4, einen Webanalysedienst der Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Irland („Google“). Google Analytics zeigt uns, wie Besucher unsere Website nutzen, etwa welche Seiten sie aufrufen, wie lange sie bleiben und über welche Website sie zu uns kommen. Dafür setzt Google die Cookies „_ga“ und „_ga_43W94C9GRX“ (Laufzeit bis zu zwei Jahre) und verarbeitet Nutzungsdaten wie aufgerufene Seiten, Referrer, Browser, Betriebssystem und deinen ungefähren Standort (Land und Region). Deine IP-Adresse nutzt Google nur, um den ungefähren Standort zu bestimmen, und speichert sie nicht. Google Analytics laden wir erst, nachdem du zugestimmt hast; vorher werden keine Daten an Google übertragen. Die Daten werden nach spätestens 14 Monaten gelöscht.
Rechtsgrundlage ist deine Einwilligung (Art. 6 Abs. 1 lit. a DSGVO, § 25 Abs. 1 TDDDG). Mit Google haben wir einen Vertrag über die Auftragsverarbeitung geschlossen (Art. 28 DSGVO). Google kann die Daten auch in den USA verarbeiten. Google LLC ist nach dem EU-US Data Privacy Framework zertifiziert (Art. 45 DSGVO); zusätzlich sind Standardvertragsklauseln vereinbart (Art. 46 Abs. 2 lit. c DSGVO). Deine Einwilligung kannst du jederzeit mit Wirkung für die Zukunft widerrufen, über das Cookie-Symbol unten links auf jeder Seite. Wir löschen die Cookies von Google Analytics dann aus deinem Browser. Werbedienste (Kategorie Marketing) setzen wir derzeit nicht ein; sollte sich das ändern, ergänzen wir diese Datenschutzbestimmungen und fragen dich erneut. 11. Empfänger und Übermittlungen in Drittländer
Deine Daten erhalten nur die hier genannten Dienstleister Cloudflare, Microsoft und Mailchimp sowie, wenn du Statistik zulässt, Google, und zwar nur, soweit es für den jeweiligen Zweck erforderlich ist. Dabei kann es zu Übermittlungen in die USA kommen; die jeweiligen Garantien beschreiben wir in den Abschnitten oben. An Behörden geben wir Daten nur weiter, wenn wir gesetzlich dazu verpflichtet sind.
12. Datensicherheit
Die Website wird verschlüsselt über HTTPS (TLS) übertragen, auch deine Eingaben in unseren Formularen. Wir treffen angemessene technische und organisatorische Maßnahmen, um deine Daten vor Verlust, Manipulation und unberechtigtem Zugriff zu schützen.

Widerspruchsrecht: Verarbeiten wir deine Daten auf Grundlage unseres berechtigten Interesses (Art. 6 Abs. 1 lit. f DSGVO), kannst du dieser Verarbeitung aus Gründen, die sich aus deiner besonderen Situation ergeben, jederzeit widersprechen (Art. 21 DSGVO). Wir verarbeiten deine Daten dann nicht mehr, es sei denn, wir können zwingende schutzwürdige Gründe nachweisen, die deine Interessen, Rechte und Freiheiten überwiegen, oder die Verarbeitung dient der Geltendmachung, Ausübung oder Verteidigung von Rechtsansprüchen.

Schickst du uns einen Antrag zu deinen Rechten, über das Formular oder per E-Mail, verarbeiten wir deine Angaben, um ihn zu bearbeiten und nachweisen zu können, dass wir ihn erledigt haben (Art. 6 Abs. 1 lit. c DSGVO in Verbindung mit Art. 12 DSGVO). This Privacy Policy explains which personal data we process when you visit our website www.nuicorn.eu, contact us, subscribe to our newsletter or sign up to be informed about changes to our legal documents. It applies only to this website. For our profiles on LinkedIn, X and GitHub, the Privacy Notice for Social Media (opens in a new tab) applies. Our products and platforms operate their own websites with their own privacy notices.
In brief:
- We use cookies and analytics services only with your consent: Google Analytics, if you allow statistics („Statistik“) in the cookie banner. We do not use advertising services.
- We process personal data only insofar as this is necessary to operate the website or you provide it to us yourself: via the contact form, by email, when signing up for the newsletter or for the notifications about changes.
- We do not sell data and do not use it for advertising profiles.

3. Hosting and provision of the website
Our website is hosted by Cloudflare, Inc., 101 Townsend St., San Francisco, CA 94107, USA (“Cloudflare”). Cloudflare provides the servers, a worldwide network for delivering the content (content delivery network), the name resolution for our domain and protection against attacks.
Each time the website is accessed, Cloudflare processes the data that your browser transmits for technical reasons:
- IP address,
- date and time of access,
- page or file accessed and amount of data transferred,
- the website from which you came to us (referrer),
- browser, operating system and language setting.
This data is necessary to display the website to you and to ensure its stable and secure operation, in particular to detect and fend off attacks and misuse. The legal basis is our legitimate interest in the secure and reliable provision of the website (Art. 6(1)(f) GDPR).
To protect our forms against misuse, we limit the number of requests that can be sent from one IP address within one minute. For this purpose, the IP address is processed only briefly and is not stored permanently. Error and execution logs of our application that are generated at Cloudflare are automatically deleted after seven days at the latest.
In addition, we use Cloudflare Turnstile to protect our forms (contact, newsletter, notifications about changes and deletion requests) against automated submissions. When a form comes into view or you select one of its fields, your browser loads a script from Cloudflare (challenges.cloudflare.com) for this purpose. It checks in the background whether a human is using the page and, for this purpose, processes your IP address, technical characteristics of your browser and your connection, such as the browser identifier (user agent) and the TLS fingerprint, as well as the website on which the form is located. Cloudflare does not receive what you enter in the form. Usually, you will not notice the check; only in cases of doubt does Turnstile ask you to click a checkbox. Turnstile does not set cookies, but it creates an entry for challenges.cloudflare.com in your browser's local storage (“cf.turnstile.u”), which Cloudflare uses for the check and which remains there until you delete it. The result of the check is a verification code that is valid for five minutes and is sent to our server with your submission. The server has Cloudflare confirm it once, together with your IP address, and does not store it.
The legal basis is our legitimate interest in protecting our forms and mailboxes against spam and misuse (Art. 6(1)(f) GDPR). Insofar as Turnstile stores or reads information in your browser for this purpose, this is strictly necessary so that we can securely provide the forms you want to use (§ 25(2) no. 2 TDDDG, the German Telecommunications Digital Services Data Protection Act). For the check, Cloudflare processes the data on our behalf. To improve Turnstile's bot detection, Cloudflare also uses it as an independent controller, based on its legitimate interest. We have concluded a data processing agreement with Cloudflare (Art. 28 GDPR). Cloudflare may also process data in the USA. Cloudflare is certified under the EU-US Data Privacy Framework, for which there is an adequacy decision of the European Commission (Art. 45 GDPR); in addition, standard contractual clauses have been agreed (Art. 46(2)(c) GDPR). 4. Background videos
We deliver all background videos on this website via Cloudflare Stream, a video service of Cloudflare. Your browser loads these videos from Cloudflare's servers and, in doing so, transmits your IP address and the technical information from Section 3. No cookies are set in the process.
The legal basis is our legitimate interest in the fast and reliable delivery of video content (Art. 6(1)(f) GDPR). The data processing agreement and the safeguards for transfers to the USA from Section 3 apply.
5. Fonts and other content
We deliver fonts, icons and images ourselves together with the website (Section 3). No connections to external font providers such as Google Fonts take place.
6. Contact form and contact by email
If you write to us via the contact form, we process your name, your email address and your message, your company and your website if you provide them, as well as the page from which you sent the enquiry, and the time of the enquiry. An invisible check field helps us detect automated spam submissions; we do not collect any further data for this.
The website does not store your details. They are transmitted directly to us as an email via Cloudflare's email service. Our email mailbox is operated by Microsoft Ireland Operations Limited, One Microsoft Place, South County Business Park, Leopardstown, Dublin 18, D18 P521, Ireland (“Microsoft”), as part of Microsoft 365. Emails that you write to us directly are also stored there.
We process your details in order to respond to your enquiry. The legal basis is Art. 6(1)(b) GDPR if your enquiry is aimed at a contract or a collaboration, and otherwise our legitimate interest in responding to enquiries (Art. 6(1)(f) GDPR).
We delete your enquiry as soon as it has been fully dealt with, unless statutory retention obligations, for example under commercial or tax law, require longer storage.
We have concluded a data processing agreement with Microsoft. Microsoft may also process data in the USA. Microsoft Corporation is certified under the EU-US Data Privacy Framework; in addition, standard contractual clauses have been agreed. More on this in Microsoft's privacy statement.
7. Newsletter
With our newsletter, we provide information about NUICORN, our products and platforms, as well as posts and developments relating to artificial intelligence. To sign up, we only need your email address.
We use the double opt-in procedure: after you sign up, you receive an email with a confirmation link. Only when you click it do we add you to the mailing list. To be able to prove your consent, we store the time of the sign-up and of the confirmation as well as the IP address used in the process.
For sending and managing the newsletter, we use Mailchimp, a service of The Rocket Science Group LLC, 405 N Angier Ave. NE, Atlanta, GA 30308, USA (“Mailchimp”). Your email address and the sign-up data are stored on Mailchimp's servers in the USA. We have concluded a data processing agreement with Mailchimp. As part of the Intuit group, Mailchimp is certified under the EU-US Data Privacy Framework (Art. 45 GDPR); in addition, standard contractual clauses have been agreed. More on this in the Intuit Mailchimp privacy statement.
Our newsletters contain an invisible tracking pixel and personalised links. This allows us to see whether and when a newsletter was opened and which links were clicked. We use this analysis to improve our content and do not create advertising profiles from it.
The legal basis for the newsletter and its analysis is your consent (Art. 6(1)(a) GDPR, § 25(1) TDDDG). You can withdraw it at any time with effect for the future, via the unsubscribe link in every newsletter or by email to . You cannot opt out of the analysis separately; if you do not want it, please unsubscribe from the newsletter.
After you unsubscribe, we keep your email address on a block list so that you do not receive any further newsletters, and we retain the proof of your consent for as long as claims can be asserted on its basis, usually three years. The legal basis is our legitimate interest in sending newsletters in a legally compliant manner (Art. 6(1)(f) GDPR).
8. Notifications about changes to the legal documents
On this page, you can sign up to receive an email from us when we change one of our legal documents. For this, we only need your email address. As with the newsletter, the sign-up uses the double opt-in procedure via Mailchimp; what happens to your data there, where it is stored and which safeguards apply is set out in Section 7. In Mailchimp, we mark your address as a recipient of these notifications. The notifications come from . For these, we do not analyse whether you open them or click links.
The legal basis is your consent (Art. 6(1)(a) GDPR). You can withdraw it at any time with effect for the future, via the unsubscribe link in every notification or by email to . The newsletter and the notifications share one recipient list in Mailchimp: if you have subscribed to both, the unsubscribe link ends both. If you only want to unsubscribe from one of them, write to us at the respective address. After you unsubscribe, the same applies to your data as for the newsletter (Section 7).
9. Links to social networks and other websites
We link to our profiles on LinkedIn, X and GitHub as well as to sources and other websites. Below our posts, you can share articles on Facebook, X and LinkedIn via links. These are simple links, not embedded plugins: as long as you do not click them, no data is transferred to these providers. After the click, the privacy policy of the respective provider applies. How we process data in our profiles on LinkedIn, X and GitHub is explained in the Privacy Notice for Social Media (opens in a new tab).
10. Cookies, consent and Google Analytics
On your first visit, we ask you in a cookie banner which types of cookies you allow. Necessary storage is always active; statistics and marketing remain switched off until you allow them. We store your choice only in your browser's local storage (localStorage), not on our servers. This storage is strictly necessary to manage your consent and is therefore permitted without consent (§ 25(2) no. 2 TDDDG). We deliver the banner (Silktide Consent Manager) ourselves; no data is transferred to third parties in the process.
If your browser sends the “Global Privacy Control” (GPC) signal, we treat this like the choice “Only necessary” („Nur notwendige“): the banner does not open by itself, statistics and marketing stay off, and an earlier consent is deemed withdrawn as soon as your browser sends the signal. Using the cookie icon at the bottom left, you can still deliberately switch on either of them.
If you allow statistics, we use Google Analytics 4, a web analytics service of Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). Google Analytics shows us how visitors use our website, for example which pages they visit, how long they stay and from which website they come to us. For this purpose, Google sets the cookies “_ga” and “_ga_43W94C9GRX” (lifetime of up to two years) and processes usage data such as pages visited, referrer, browser, operating system and your approximate location (country and region). Google uses your IP address only to determine the approximate location and does not store it. We load Google Analytics only after you have consented; before that, no data is transferred to Google. The data is deleted after 14 months at the latest.
The legal basis is your consent (Art. 6(1)(a) GDPR, § 25(1) TDDDG). We have concluded a data processing agreement with Google (Art. 28 GDPR). Google may also process the data in the USA. Google LLC is certified under the EU-US Data Privacy Framework (Art. 45 GDPR); in addition, standard contractual clauses have been agreed (Art. 46(2)(c) GDPR). You can withdraw your consent at any time with effect for the future via the cookie icon at the bottom left of every page. We then delete the Google Analytics cookies from your browser. We do not currently use advertising services (Marketing category); should this change, we will supplement this Privacy Policy and ask you again. More about cookies in our GDPR and Cookie Guidelines (opens in a new tab).
11. Recipients and transfers to third countries
Your data is received only by the service providers named here, Cloudflare, Microsoft and Mailchimp, and, if you allow statistics, Google, and only insofar as this is necessary for the respective purpose. This may involve transfers to the USA; we describe the respective safeguards in the sections above. We disclose data to authorities only if we are legally obliged to do so.
12. Data security
The website is transmitted in encrypted form via HTTPS (TLS), including your entries in our forms. We take appropriate technical and organisational measures to protect your data against loss, manipulation and unauthorised access.
13. Your rights
Under the GDPR, you have the right to
- information about the data we store about you (Art. 15 GDPR),
- rectification of inaccurate data (Art. 16 GDPR),
- erasure of your data (Art. 17 GDPR),
- restriction of processing (Art. 18 GDPR),
- data portability (Art. 20 GDPR),
- withdraw a consent with effect for the future (Art. 7(3) GDPR),
- lodge a complaint with a data protection supervisory authority (Art. 77 GDPR).
Right to object: If we process your data on the basis of our legitimate interest (Art. 6(1)(f) GDPR), you can object to this processing at any time on grounds relating to your particular situation (Art. 21 GDPR). We will then no longer process your data unless we can demonstrate compelling legitimate grounds that override your interests, rights and freedoms, or the processing serves the establishment, exercise or defence of legal claims.

The competent supervisory authority for us is the Berlin Commissioner for Data Protection and Freedom of Information (Berliner Beauftragte für Datenschutz und Informationsfreiheit), Alt-Moabit 59–61, 10555 Berlin, www.datenschutz-berlin.de. However, you can also contact any other supervisory authority, in particular the one at your place of residence. How we handle requests is described in our GDPR and Cookie Guidelines (opens in a new tab).
If you send us a request regarding your rights, via the form or by email, we process your details in order to handle it and to be able to prove that we have dealt with it (Art. 6(1)(c) GDPR in conjunction with Art. 12 GDPR). The form transmits your name, your email address, your other details, your browser's Google Analytics ID if you wish, and the time via Cloudflare's email service to our mailbox (see Section 6); the website itself does not store anything. We keep the record of the request for as long as we have to prove that it has been dealt with, usually three years.
14. Obligation to provide data, no automated decision-making
You are not obliged to provide us with personal data. Without the mandatory information in the contact form, however, we cannot process your enquiry, and without an email address we can send you neither the newsletter nor notifications about changes. Automated decision-making, including profiling (Art. 22 GDPR), does not take place.
15. Changes
We adapt this Privacy Policy when our website, the services we use or the legal situation change. The version published on this page at any given time applies. On request, we will notify you by email of every change (Section 8).

Ziehst du deine Einwilligung in die Statistik zurück, löschen wir die Cookies von Google Analytics aus deinem Browser und laden die Seite neu. Unsere Formulare schützt Cloudflare Turnstile vor automatisierten Einsendungen. Kommt ein Formular in den sichtbaren Bereich, legt Turnstile im lokalen Speicher deines Browsers einen Eintrag für challenges.cloudflare.com an („cf.turnstile.u“), den Cloudflare für die Prüfung nutzt und der dort bleibt, bis du ihn löschst; Cookies setzt Turnstile nicht. Auch dieser Eintrag dient ausschließlich der Sicherheit und ist ohne Einwilligung zulässig (§ 25 Abs. 2 Nr. 2 TDDDG). Dein Browser speichert außerdem Dateien unserer Website wie Bilder, Schriften und Videos in seinem Zwischenspeicher (Cache), damit Seiten schneller laden. Das ist eine Funktion deines Browsers, die du in seinen Einstellungen steuern kannst.
Zählpixel verwenden wir nur in unseren Newsletter-E-Mails und nur mit deiner Einwilligung; mehr dazu im Abschnitt „Newsletter“ unserer Datenschutzbestimmungen (öffnet in neuem Tab).
In den Einstellungen deines Browsers kannst du Cookies jederzeit einsehen, löschen und blockieren. Unsere Website funktioniert in der Regel auch dann, wenn du Cookies blockierst.
4. Deine Rechte nach der DSGVO
- Auskunft (Art. 15 DSGVO): Du kannst erfahren, ob und welche Daten wir über dich verarbeiten, zu welchem Zweck, an wen wir sie weitergeben und wie lange wir sie speichern, und eine Kopie dieser Daten erhalten.
- Berichtigung (Art. 16 DSGVO): Unrichtige oder unvollständige Daten berichtigen oder ergänzen wir.
- Löschung (Art. 17 DSGVO): Wir löschen deine Daten, wenn wir sie nicht mehr brauchen, du deine Einwilligung widerrufst oder ein anderer gesetzlicher Löschgrund vorliegt, soweit keine Aufbewahrungspflicht entgegensteht.
- Einschränkung (Art. 18 DSGVO): Unter bestimmten Voraussetzungen, etwa solange wir die Richtigkeit deiner Daten prüfen, schränken wir die Verarbeitung ein.
- Datenübertragbarkeit (Art. 20 DSGVO): Daten, die du uns auf Grundlage einer Einwilligung oder eines Vertrags bereitgestellt hast, erhältst du in einem gängigen, maschinenlesbaren Format.
- Widerspruch (Art. 21 DSGVO): Verarbeitungen auf Grundlage unseres berechtigten Interesses kannst du aus Gründen deiner besonderen Situation widersprechen.
- Widerruf (Art. 7 Abs. 3 DSGVO): Eine Einwilligung, etwa für den Newsletter, kannst du jederzeit mit Wirkung für die Zukunft widerrufen.
- Beschwerde (Art. 77 DSGVO): Du kannst dich bei einer Datenschutz-Aufsichtsbehörde beschweren. Für uns zuständig ist die Berliner Beauftragte für Datenschutz und Informationsfreiheit.
5. So machst du deine Rechte geltend
Schreib uns formlos an oder per Post an die Anschrift im Impressum (öffnet in neuem Tab). Die Löschung deiner Daten kannst du auch über das Formular unter diesen Dokumenten (öffnet in neuem Tab) beantragen. Wir antworten innerhalb eines Monats. Bei komplexen Anfragen kann sich diese Frist um bis zu zwei weitere Monate verlängern; darüber informieren wir dich rechtzeitig. Die Bearbeitung ist kostenlos. Haben wir begründete Zweifel an deiner Identität, bitten wir dich um zusätzliche Angaben, damit wir keine Daten an Unbefugte herausgeben.
6. Übermittlungen außerhalb der EU
Einige unserer Dienstleister haben ihren Sitz in den USA. Wir arbeiten dort nur mit Anbietern zusammen, die nach dem EU-US Data Privacy Framework zertifiziert sind, und haben zusätzlich Standardvertragsklauseln der EU-Kommission vereinbart. We use the profiles to provide information about NUICORN, our products, platforms and topics and to get in touch with interested parties. We use the statistics to improve our posts.
